Terms and conditions of sale

These General Terms and Conditions of Sale apply to the sale of products on our website ("clipshawaii.com"). "We" refers to CLIPS, the operator of clipshawaii.com.


Article 1: Our Business Policy

CLIPS offers products for sale on clipshawaii.com and its e-commerce services are available only to end users, i.e. "consumers."

"Consumer" means an individual acting for purposes that are outside the scope of his/her trade, business or profession. If you are not a "Consumer", please refrain from purchasing any products on clipshawaii.com.

CLIPS reserves the right not to process orders received from users who are not "consumers" and other orders that do not comply with CLIPS' business policies.

These General Terms and Conditions of Sale govern exclusively the offer, submission and acceptance of purchase orders (hereinafter referred to as "Orders") between users of clipshawaii.com and CLIPS for products on clipshawaii.com.



Article 2 How to enter into a contract with CLIPS

To place an order to purchase one or more products on clipshawaii.com, you must follow the relevant instructions, fill in all fields on the membership registration form (for new purchases) and electronic order form (hereinafter referred to as the "Order Form") starting from the shopping cart page, and submit it to CLIPS.

The order form contains links to these General Terms and Conditions of Sale, our Privacy Policy, and the Returns and Refunds Policy, as well as information about the content and price of each ordered product, the payment methods you will use to purchase each product, the delivery conditions for purchased products, and shipping costs.

An order shall be deemed submitted upon electronic receipt by CLIPS of your order form.

Before submitting your order form for the purchase of products, you are advised to read these General Terms and Conditions of Sale carefully and to print a copy using the print function and to save or reproduce a copy for your own personal use.

Before submitting the order form, you are invited to check and correct possible errors.

After your order form has been submitted, CLIPS will process your purchase order.

The order form will be filed in our database for the period necessary to process your purchase order and as required by law.

Please note that CLIPS cannot process the following types of orders:

Orders that are deemed to lack sufficient proof of ability to pay, incomplete orders, orders with inaccurate information, and orders for products that are already out of stock. *As we sell products simultaneously at CLIPS stores, there may be cases where an item is out of stock even after an order has been submitted.

In the above cases, we will inform you by e-mail that your order could not be processed, specifying the reasons for this. If the products displayed on clipshawaii.com are already out of stock at the time of your order submission, CLIPS will inform you of the unavailability of the ordered products within 15 days of receipt of your order. If an order form has already been sent and the price paid for such out-of-stock products, CLIPS will refund the price of the out-of-stock products in full.

By submitting an order form, you agree to enter into a contract with CLIPS and unconditionally accept and undertake to abide by the provisions of these General Terms and Conditions of Sale. If you do not agree to certain provisions of these General Terms and Conditions of Sale, please do not submit an order form for the purchase of products on clipshawaii.com.

By submitting your order form, you agree to and accept these General Terms and Conditions of Sale as well as the additional terms and conditions contained in the links on clipshawaii.com (Privacy Policy, Returns and Refunds, Shipping and Customs Charges).

Once you have submitted your order form, CLIPS will send you a confirmation email (Purchase Order Receipt) containing a summary of the information related to the order form.



Article 3 Guarantee and Product Price Display
On clipshawaii.com, we offer for sale high-quality products, which are purchased by CLIPS directly from carefully selected manufacturers and authorized dealers with strict quality control.

CLIPS does not sell defective products or products of lower quality compared to equivalent standards offered on the market.

The main characteristics of the products are shown on each product page on clipshawaii.com. The products offered for sale on clipshawaii.com may not strictly correspond to the real products in terms of image and color due to the Internet browser and monitor used.

Prices are subject to change at any time, so please check the final sales price before submitting your order form.

For custom surfboard orders, the displayed price is an estimate. Our customer service will contact you at a later date with the final price.

All products are delivered with inspection tags attached. If you wish to return a purchase, please ensure that all price tags, inspection tags and other labels are intact.

If you decide to exercise your right to return a purchased item, CLIPS will not accept returned items that are returned without price tags, inspection tags or other labels, or that have been altered from their original condition or damaged.



Article 4 Payment

Payment for the products and associated shipping charges must be made using the payment method selected in the order form. clipshawaii.com only accepts credit card payments.

When paying by credit card, all details (e.g. card number and expiry date) are transmitted to the financial partner via encrypted protocol (SSL) without third parties having any access to them. Such details are not used by CLIPS or its partners except in the following cases:
A) When carrying out procedures related to a purchase
B) In the event of a return, we will refund you in accordance with your return rights.
C) In the unlikely event that a fraud case occurs, you will need to report it to the police.

The purchase price of the products, as identified on the order form, and any associated shipping charges will only be charged to your credit card when the purchased products are actually shipped.



Article 5 Customs Duties

If you are shipping an order to a country other than the United States, import duties may be imposed by the customs office of the importing country. These duties will be borne by the customer.



Article 6 Shipping and Delivery of Products For the specific shipping and delivery procedures for ordered products, please refer to Shipping Costs and Customs Duties and Delivery of Products. The information provided in these sections forms an integral part of these General Terms and Conditions of Sale and is therefore deemed to have been fully acknowledged and accepted by you when your order form is submitted.

Article 8 Returns As a general rule, surfboards cannot be returned. However, returns will be accepted if there is a defect that significantly affects use. All other products, whether regular priced or sale items, can be returned. However, only products that are unworn, unwashed, and have the product tag and inspection tag still attached, can be returned. Returns to our company must be postmarked within 7 days of receipt of the product. If the above conditions are not met, we will not accept returns. In that case, please note that the product will be resent. Please note that refunds for sale items will be made in the form of store credit as a general rule.

If you would like to return your item, please contact us at info@clipshawaii.com. You will receive a confirmation email from our customer service within 24-48 hours. Once your return has been approved, please follow the instructions on the return form included in your package to return the item. Please note that you will be responsible for the shipping costs to Hawaii.



Article 9 Exchange

clipshawaii.com does not offer exchanges, if you would like to exchange an item please complete the return process and place a new order.



Article 10 Refund Timing and Procedures Once we receive the returned product and check that all the necessary conditions for return are met, we will refund the product price to the credit card you used to purchase the product.

If you paid by postal money order, the refund will be made by bank transfer from the United States to your Japanese account, and you will be responsible for any bank transfer fees.

For sale items, the product price will be returned as a store credit to your online account. The store credit can be used toward your next purchase. Please note that store credits cannot be used at our Hawaii stores. Once the refund has been processed, you will receive a confirmation email.

You can check the credit card refund process on the statement issued by your card company. Please note that the time it takes for the refund to be reflected on your statement may vary depending on the card company.



Article 11 Price Adjustment

At clipshawaii.com, we accept requests for price adjustments if the price of a product purchased at regular price drops within 7 days of purchase. However, price adjustments are only possible if the same product (same size, same color) as the purchased product is in stock at clipshawaii.com at the time of the request. Price adjustments cannot be applied to products purchased at sale prices.

If you would like to request a price adjustment, please contact us by email at info@clipshawaii.com within one week of the price reduction. After checking the stock availability, if the price adjustment is approved, we will refund the difference to the credit card you used at the time of purchase. At the same time, we will send you an email confirming the refund.

Article 13 Governing Law

These General Terms and Conditions of Sale and any orders submitted to CLIPS constitute a contract governed by US law.



Article 14 Changes and Updates

These General Terms and Conditions of Sale may be amended from time to time to take into account new legislation and other changes. The new General Terms and Conditions of Sale shall come into force when published on clipshawaii.com.
