These General Terms and Conditions of Sale govern the offer and sale of products on our web site (clipshawaii.com). The products purchased on clipshawaii.com are directly sold by CLIPS.
Our Businesss Policy
CLIPS offers products for sale on clipshawaii.com and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers." "Consumer" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on clipshawaii.com. CLIPS reserve the right not to process orders received from users who are not "Consumers" and any other order which does not comply with CLIPS's business policy. These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on clipshawaii.com between the users of clipshawaii.com and CLIPS. The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties which are on clipshawaii.com through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that you verify the third party's terms and conditions of the web site from which you may be considering purchasing a product, since CLIPS shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between the users of clipshawaii.com and third parties.
How to Execute a Contract with CLIPS
In order to place an order for the purchase of one or more products on clipshawaii.com, you must fill out the electronic order form and send it electronically to CLIPS, following the relevant instructions. The order form contains links to these General Terms and Conditions of Sale and other important policies, information on the main characteristics of each product ordered and the relevant unit price (including all applicable fees), and the type of payment that you may use in order to purchase our products. Please note that the unit price indicated in the order form does not include duties, taxes and fees you may need to pay to local authorities. An order shall be deemed to have been submitted upon the electronic receipt by CLIPS of your order form. Before submitting your order form for the purchase of products, please carefully read the General Terms and Conditions of Sale. The order form will be filed in our data base for such a period of time required in order to process your order and as provided by law. Before placing the order form, you will be asked to identify and correct possible input errors. After the contract has been executed, CLIPS will keep up your purchase order. CLIPS may not keep up purchase orders that do not give sufficient guarantees of solvency or which are incomplete or incorrect, or orders for products that are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that CLIPS has not carried out your purchase order specifying the reasons thereof. If the products displayed on clipshawaii.com are no longer available once CLIPS has received your order form, CLIPS shall inform you within 15 working days of receipt of your order of the unavailability of the ordered products. If the order form has been sent and the price has been paid for items that are no longer available, CLIPS will refund you the sum paid. By submitting an order form and contracting with CLIPS, you unconditionally accept to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on clipshawaii.com. By sending the order form, you confirm to acknowledge and accept these General Terms and Conditions of Sale as well as all of the further conditions contained on clipshawaii.com (also through links.) Upon submission of your order form, CLIPS shall send to you, via e-mail, a receipt of the purchase order, containing a summary of the information related to the order form (the products' main characteristics, a detailed indication of the item price, terms of payment and shipping costs). For international orders, please note that all and any item price is provided without duties, taxes or fees that you may need to pay to local authorities to receive the merchandise. Please note as well that due to fluctuations in exchange rates and merchandise components CLIPS will not be able to provide you in advance with information on the amount of duties and taxes that may be owed to local authorities. These amounts should be considered above and beyond the total of the order.
Warranties and Indication of Product Prices
On clipshawaii.com, we offer for sale luxury and top-quality products. These products are purchased by CLIPS directly from fashion houses, manufacturers and dealers, carefully selected by stringent quality control. CLIPS does not sell second-hand products (unless marked vintage), flawed products or products of lower quality as compared to the corresponding standards offered on the market. The main characteristics of products are shown on clipshawaii.com inside each product schedule. The products offered for sale on clipshawaii.com may not exactly correspond to the real garments in terms of image and colours because of the Internet browser and/or the monitor used. Prices are subject to change. Check item prices before sending the relevant order form. Orders from countries not included among those displayed on the Help page cannot be accepted by CLIPS. All products come with an inspection label attached. Do not remove the label or relevant seal from the purchased products should you wish to return the purchased product. Should you decide to exercise your right to return purchased products, CLIPS will not accept returned products that are returned without the relevant label or seal or that have been altered from their original status or damaged.
Customs and Duties on International Orders
If you order from a country outside United States, upon arrival in your country the contents of your order may likely be subject to customs fees (taxes, duties, processing fees, brokerage fees, etc.), which are the responsibility of the person(s) receiving the order. These fees are not under CLIPS's control. For this reason we recommend you verify with your local customs office for more information about these fees before you place an order. CLIPS is unable to estimate customs fees, taxes, duties, etc. so please contact your local authorities or customs office for detailed information. Both the item prices as well as the shipping charges you pay to CLIPS do NOT include customs fees, import taxes, brokerage fees, or duties. Should you refuse your order at the time of arrival or should you refuse to pay the customs fees when your order arrives, the shipment will be returned to CLIPS and we will be charged the customs fees plus return shipping costs. If CLIPS has been charged for the above mentioned amounts (taxes, duties, processing fees, brokerage fees, etc.) the cost of the fees will be deducted from your refund for the returned items. CLIPS will not issue a refund for those amounts.
Payment of product prices and relevant shipping costs can be made only with a credit card and PayPal (US customers only). All details (for example, card number or expiration date) will be sent by encrypted protocol to Authorize.net or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by CLIPS except for performing the procedure relevant to your purchase or issuing relevant refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of frauds to the police. For International order, please note that you may need to pay additional import fees, taxes, brokerage fees and handling fees to your local authorities or customs offices. The price for the purchase of products and the relevant shipping costs, as indicated in the order form, will be charged to your current account only when the purchased products are actually delivered.
Shipping and Delivery of the Products

The information provided in these sections form an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully known and accepted by you at the time your order form is sent.

CLIPS will gladly accept returns for regular priced items that were purchased by credit card and is in its original condition. Sale items can be returned for store credit only. Items that have the tags cut off or have been worn, used, or washed will not be accepted. CLIPS will accept returns within 14 days from the date of delivery. The returned package MUST be postmarked within 14 days from the date of delivery or CLIPS will refuse the return. We recommend you to insure your package for unpredictable damages and losses. To request a return, please log into clipshawaii.com, go to the My Account page and see the Request a Return section, or feel free to email or call our Customer Service Department. Also, check the return claim form enclosed with your shipment for additional information about returning an item. If any package is sent to us without prior authorization, CLIPS reserves the right to refuse the package. After CLIPS receives, processes and confirms that your returned item meets the Return Policy requirements, you will receive an e-mail notifying you that your refund has been processed. Refunds are processed within approximately 3-5 business days of our receipt of your merchandise. Your refund will be credited back to the same card used to make the original purchase or in the case of sale items, store credit will be issued to your clipshawaii.com shopper account (store credit can be used online or in-store). Remember that we do not refund delivery costs, only the amount paid for the item you have decided to return. Refund times will depend on your credit card company's policies.
In order to serve you most efficiently, we do not offer merchandise exchanges. Please follow a return procedure and make new order for a desired item/size.
Sale Price Adjustment Policy
clipshawaii.com will gladly offer a sale price adjustment on items purchased up to 7 days prior to the commencement date of a sale. Please be aware that the exact style and size of an item must be available for purchase at the time your request is made before any adjustment in the sale price can be approved. A approved sale price adjustment will be credited back to the credit card used to make the original purchase. We are unable to offer price adjustment on items originally purchased in a sale or discounted price.
The laws of the State of Hawaii (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions shall be brought solely in the City of Honolulu, State of Hawaii.
Amendments & Updates
The General Terms and Conditions of Sale may be amended from time to time, in consideration of new laws and regulations but not limited thereto. The new General Terms and Conditions of Sale shall be effective as of the date of publication on clipshawaii.com.
